1. Acceptance of Terms
By accessing or using Pentesty ("the Service"), you agree to be bound by these Terms of Use. If you do not agree with any part of these terms, you may not use the Service. These terms apply to all users, including individuals and organizations.
2. Description of Service
Pentesty provides an AI-powered automated penetration testing platform that uses industry-standard security tools (including Nuclei, Subfinder, Nmap, and others) combined with large language model analysis to identify and report vulnerabilities in web applications and network infrastructure.
3. Authorized Use Policy
You must only use Pentesty to scan systems, applications, or networks that you own or for which you have explicit written authorization from the owner. Unauthorized scanning is illegal in most jurisdictions and violates these Terms. By initiating any scan, you confirm that you have the legal right to test the target. Pentesty is not responsible for any scans initiated without proper authorization.
4. Prohibited Activities
You may not use the Service to: (a) scan targets without authorization; (b) conduct denial-of-service attacks or disruptive testing; (c) harvest or collect data about third parties without consent; (d) circumvent security controls or authentication mechanisms of systems you do not own; (e) distribute, sell, or resell access to the Service without authorization; (f) violate any applicable local, national, or international law or regulation.
5. Account Registration
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account at support@pentesty.co. We reserve the right to terminate accounts that violate these Terms.
6. Intellectual Property
The Service, including its software, reports generated by AI models, templates, and documentation, is owned by Pentesty and protected by applicable intellectual property laws. You retain ownership of data you submit. You grant Pentesty a limited license to process your data solely to provide the Service.
7. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. Security testing results are probabilistic and may not identify all vulnerabilities. Pentesty does not guarantee that scan results are complete, accurate, or current.
8. Limitation of Liability
To the fullest extent permitted by law, Pentesty shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of or inability to use the Service. Our total liability for any claim shall not exceed the amount you paid for the Service in the three months preceding the claim.
9. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated date. Continued use of the Service after changes constitutes acceptance of the new Terms. We encourage you to review this page periodically.
10. Governing Law
These Terms shall be governed by and construed in accordance with applicable law. Any disputes shall be subject to the exclusive jurisdiction of the competent courts in the applicable jurisdiction.
